DUI (driving under the influence) or DWI (driving while intoxicated) are serious offenses in California.
A DUI occurs when a driver operates a vehicle while under the influence of either drugs or alcohol, and a test results in a blood alcohol level (BAC) of .08 or higher. Drivers with a Commercial Driver’s License face more stringent laws and can incur a DUI with a BAC of just .04. California has “zero tolerance” laws making it illegal for underage drivers (those under 21 years old) to get behind the wheel with a BAC of .01% or more.
In California, the penalties for a DUI vary based on the circumstances of the case and the person’s prior criminal record. However, the law provides a range of penalties for a first, second, and third DUI.
The minimum penalties for a first time DUI offense are up to $1,000 in fines and additional court fees, up to 6 months jail, 6 months driver’s license suspension or up to 12-month restricted license with interlock ignition (IID), 3 – 5 years’ probation, a potential for an SR-22 tag on insurance papers for a minimum of three years, and mandatory attendance up to 9-months alcohol treatment program.
The minimum penalties for a second time DUI are: up to $1,000 in fines and additional court fees, up to 1 year jail, 2 years driver’s license suspension,18-30 months alcohol treatment plan, installation of an ignition interlock device for 1 year, drastically increased auto insurance rates, and 10 years’ probation.
The minimum penalties for a third DUI offense go up to $18,000 in fines and court fees, 120 days jail, revocation of driver’s license for three years, a 30-month alcohol treatment program, and other penalties.
Additional charges and penalties may apply if you have committed other offenses during the DUI such as having a minor child in your car, causing bodily injury to another person, or causing damage to other person’s property, or public property.
